Girl who had to be cut from car after accident awarded €45k damages

A young girl who had to be cut from her fathers car by firemen when she was 9 years of age following an accident has been rewarded €45,000 in Circuit Civil Court.

Isabella Osborne had immediately been put in a neck brace and had full spinal precautions for about four hours after she was taken from the vehicle. Mr English, who appeared with Gore and Grimes Solicitors for Isabella, said she had suffered a suspected spinal neck injury but x-rays revealed there had been no fractures, thankfully.

Her father was driving the car on the Swords -Ashbourne Road when it was rear ended by Noel McNally.

Isabella had to give up her hobbies of horse riding, ballet and swimming, but has since been able to go back horse riding. She suffered a mid-right rotator cup muscle injury which had healed with physiotherapy but had been left with mild joint pain.

The defendants insurance company made a settlement offer of €30,000 but this was not accepted and with further review into Isabella’s injury and the discovery of scapula dyskinesia from the accident, an offer of €45,000 was offered and accepted.
