Boy (10) awarded €21k after hitting his head against a hook at creche.
A 10-year-old schoolboy, who struck his head against “an S Hook” in a sports crèche, was today awarded €21,000 damages in the Circuit Civil Court.
Barrister Grainne Larkin told Circuit Court President, Mr Justice Raymond Groarke, that Antonio Bozkaya, now aged 11, had last year been attending Nzone Sports Creche, at Posey Row, Kinsealy, Dublin, when the accident happened.
Ms Larkin, who appeared with Ferrys Solicitors, Artane, Dublin, said the boy had sued Michael Nugent Tennis Academy Limited, trading as Nzone, through his mother Danielle bozkaya, of Heron Street, Aston Village, Drogheda, Co Louth.
She said Antonio had been playing in the play area when he stood up and struck his head on the metal “S” hook which had not been covered with any protective padding. He had suffered a laceration to his forehead and a soft tissue injury to his neck.
He had been brought to Our Lady of Lourdes Hospsital, Droghted, where the wound was cleaned and glued. He had later attended his GP complaining of neck pain for which he had undergone two sessions of physiotherapy.
Ms Larkin said Antonio had been left with a small permanent scar fortunately mainly hidden within his hairline.
She told the court the defendant had made a settlement offer of €21,000 which she was recommending to the court. Judge Groarke said it was a good offer and approved the settlement.
